Spanish bar owner gets jail sentence because of noise

May 8, 2007

MADRID, Spain: The Supreme Court on Monday upheld a four-year jail term against a bar and restaurant owner over continuous noise from his eatery that drove neighbors to seek medical attention.

The tribunal confirmed a lower court ruling that found the Barcelona businessman guilty of an environmental crime and ordered him to pay damages ranging from €6,000 ($8,200) and €10,000 ($13,600) in damages to each of four families with homes in the same building.

The defendant’s name was not released.

The lower court said the restaurateur had failed to install soundproofing equipment as required by Barcelona city laws.

It said the noise caused insomnia and stress for the neighbors and that two of them had sought treatment for anxiety and depression.
